Terms and conditions
These terms ('Terms') apply to you when you:
· pre-book through our pre‑booking enquiry form online at https://www.volkswagen.co.uk/en/idbuzzprebooking.html ('Site'); and
· pay the pre‑booking fee to your preferred Volkswagen Van Centre or Volkswagen Retailer ('Volkswagen Retailer'), to access the priority ordering window for the Volkswagen ID.Buzz 5-seat, 77kWh model ('Priority Ordering Window').
Please note that pre‑booking is only available on the ID.Buzz 5 seat, 77kWh model. If you are interested in the seven seat version of the ID.Buzz Cargo (which is expected to open for order later in 2022), then please speak directly to your local Volkswagen Retailer.
Please read these Terms carefully before you complete the pre‑booking enquiry form and pay your pre‑booking fee.
These Terms tell you who we are, the details of the Priority Ordering Window, how to cancel your access to the Priority Ordering Window and ask for a refund of your pre‑booking fee and other important information. In particular, please read the terms relating to the limitations of our liability to you. We recommend that you print or save a copy of these Terms for future reference.
To complete the pre‑booking enquiry form and apply for access to the Priority Ordering Window, you must confirm that you accept and will comply with these Terms. If you do not accept these Terms, then you should not complete the pre‑booking enquiry form or pay the pre‑booking fee.
The pre‑booking enquiry form is available online only at www.volkswagen-vans.co.uk (i.e. the Site). Once you have completed the form, your chosen Volkswagen Retailer will contact you to take the pre- booking fee.
If you have any questions about anything in these Terms or our pre‑booking process; if you have any technical issues with the Site; or if you wish to make a complaint, then please contact us here.
1. Who We Are
1.1 This Priority Ordering Window scheme is operated by Volkswagen Commercial Vehicles, a trading division of Volkswagen Group United Kingdom Limited ('we', 'our' or 'us', as applicable). Our registered office address is at Yeomans Drive, Blakelands, Milton Keynes MK14 5AN. Our registered company number is 514809 and our VAT registration number is 217990930.
2. Priority Ordering Window
2.1 By completing our pre‑booking enquiry form and paying a pre‑booking fee, you will benefit from access to a priority ordering window for ID.Buzz, 5-seat 77kWh production vehicle ('the production vehicle'). This Priority Ordering Window will allow you to order the production vehicle for a period of
2 weeks during which time, the relevant Volkswagen Retailer will process pre-booker orders before processing orders for the general public.
2.2 Please note that applying for or being granted access to the Priority Ordering Window, through our pre‑booking process, is not an order to purchase the production vehicle. You will need to place an order to purchase the vehicle with a Volkswagen Retailer during the Priority Ordering Window.
2.3 Accessing and/or using our pre‑booking process, paying a pre‑booking fee and securing access to the Priority Ordering Window in accordance with these Terms does not constitute a contractual sale of or order for the production vehicle.
2.4 Please see section 7 below for more information on the ordering process for the production vehicle.
2.5 Customers who use our pre‑booking process and pay a pre‑booking fee to secure access to the Priority Ordering Window under these Terms are referred to as 'Customers' in these Terms.
2.6 So long as they have provided the appropriate marketing consents, Customers will be kept up-to- date with the latest Volkswagen ID. Buzz news. Closer to the Priority Ordering Window opening, the Volkswagen Retailer you select on the pre‑booking enquiry form will be in touch to confirm pricing and specification information for the production vehicle.
2.7 Customers will be kept informed of the dates of the Priority Ordering Window. We currently anticipate that this may be in mid to late July 2022 (but this is subject to change, your chosen Volkswagen Retailer will keep you informed). If you are granted access to the Priority Ordering Window under these Terms, then it is your responsibility to place an order for the final production vehicle with the Volkswagen Retailer during the period of the Priority Ordering Window. Only Customers who place orders during this window will have priority on ordering before the general public.
3. Eligibility
3.1 UK consumers aged 18+ who complete the pre‑booking enquiry form online with us at www.volkswagen-vans.co.uk and pay a pre‑booking fee are eligible to participate in the pre‑booking process under these Terms.
3.2 Pre‑booking under these Terms is not available to fleet or business customers.
3.3 Only one pre‑booking fee may be paid per household and only the person paying the pre‑booking fee will be entitled to place an order for the production vehicle during the Priority Ordering Window.
3.4 Access to the Priority Ordering Window is non-transferable. The individual granted access to the Priority Ordering Window must be the individual who places an order for the production vehicle through the Priority Ordering Window, enters into the purchase agreement and ultimately takes ownership of the vehicle.
4. Pre‑booking fee
4.1 A pre‑booking fee payment of £2000 is required for access to the Priority Ordering Window. If you go on to order the production vehicle during the Priority Ordering Window then this pre‑booking fee payment will be deducted from the final purchase price under the purchase agreement with your Volkswagen Retailer (see section 7 below). If you do not go on to purchase the final production vehicle then the pre‑booking fee payment will be refunded in full to you in accordance with section 6 below. You can also request a refund of your pre‑booking fee payment at any time before entering into a binding purchase agreement with a Volkswagen Retailer for the production vehicle – see section 6 below.
4.2 Pre‑booking fees can only be paid to a Volkswagen Retailer, who will contact you to take payment following receipt of your pre‑booking enquiry form. You should request confirmation of payment from the Volkswagen Retailer. If you go directly to a Volkswagen Retailer to pay a pre‑booking fee without first completing the pre‑booking enquiry form, then you will not receive access to the Priority Ordering Window (and you will only be able to order when orders open to the general public).
5. Access to the Priority Ordering Window
5.1 You can apply for access to the Priority Ordering Window by completing the pre‑booking enquiry form on the Site. A contract confirming access to the Priority Ordering Window is formed between you and the Volkswagen Retailer as set out below.
5.2 Your completion of the pre‑booking enquiry form and payment of the pre‑booking fee is an offer by you to access to the Priority Ordering Window, made to the selected Volkswagen Retailer. The following steps have to be taken before access to the Priority Ordering Window is confirmed:
(a) Applying. Complete the pre‑booking enquiry form with your personal details, selected retailer and other information requested on the form and press the "submit" button;
(b) Accepting our terms. You should not complete the pre‑booking enquiry form without first confirming that you accept these Terms, as they will govern your application for access to the Priority Ordering Window.
(c) Acknowledgement of your submission. Once you have submitted the completed pre‑booking enquiry form, you will see an on-screen acknowledgement that your form has been submitted and confirming that your selected Volkswagen Retailer will contact you.
(d) Payment of the pre‑booking fee. The Volkswagen Retailer you selected as your preferred retailer will then contact you to take payment of the pre‑booking fee. Please note that submission of the pre‑booking enquiry form and payment of the pre‑booking fee does not confirm your access to the Priority Ordering Window. No contract is formed between you and the Volkswagen Retailer (and your access to the Priority Ordering Window is not confirmed) until we notify you, on behalf of the Volkswagen Retailer, as set out in (e) below.
(e) The agreement to grant you access to the Priority Ordering Window. We will send you an email that confirms if you have been granted access to the Priority Ordering Window. The contract between you and the Volkswagen Retailer giving you access to the Priority Ordering Window will only be formed when we send you an email confirming that you have been granted access ("Confirmation"). All contracts for access to the Priority Ordering Window are made between you and the Volkswagen
Retailer, not between you and us, and all enquiries regarding your access should be made to the relevant Volkswagen Retailer.
5.3 If the Volkswagen Retailer cannot grant you access to the Priority Ordering Window. If the Volkswagen Retailer is unable to grant you access to the Priority Ordering Window; for example, but not limited to, because a Volkswagen Retailer has already received and confirmed access for an individual that shares the same address as you, your payment to the Volkswagen Retailer is declined by the card provider; the Volkswagen Retailer is unable to process the transaction or the funds for your pre‑booking fee do not clear; the Priority Ordering Window is no longer available; or this scheme has been cancelled; or because of an error in the pre‑booking enquiry form on our Site, you will be informed by email. If you have already paid your pre‑booking fee, the Volkswagen Retailer will refund you the full amount as soon as possible, by the same method in which the payment was originally made. You should contact your selected Volkswagen Retailer directly regarding the refund of your pre- booking fee.
5.4 Unique reference number. When your access to the Priority Ordering Window is confirmed, you will be issued with a unique reference number. You will need this number to place an order for the production vehicle during the Priority Ordering Window and must use it in all future communications regarding your pre‑booking, with your selected Volkswagen Retailer. The unique Volkswagen ID. Buzz priority ordering reference number is personal to you and is not transferable to any other party.
6. Pre‑booking fee Refunds
6.1 You can cancel your access to the Priority Ordering Window and request a refund of your pre- booking fee at any time prior to any subsequent binding order for the purchase of a production vehicle. Please contact your selected Volkswagen Retailer directly and request a refund.
6.2 A refunded pre‑booking fee ends any rights to access the Priority Ordering Window.
6.3 After the Priority Ordering Window has closed, please contact your selected Volkswagen Retailer directly and request a refund if you did not place an order for the production vehicle.
7. Production Vehicle Order and Purchase Agreement
7.1 Customers will be contacted with the dates when the Priority Ordering Window will be open. If you have been granted access to the Priority Ordering Window and paid a pre‑booking fee under these Terms, then you will be able to place an order with a Volkswagen Retailer for the production vehicle from the opening of the Priority Ordering Window, regardless of when you paid your pre‑booking fee. Confirmation of your order for the production vehicle will be when the final purchase agreement is signed.
7.2 To purchase a production vehicle you will need to visit the applicable Volkswagen Retailer to enter into the relevant agreement(s). A representative of the relevant Volkswagen Retailer will provide and discuss with you the terms of the contract for the purchase of the vehicle and, if you decide to proceed with the purchase, the contract will be entered into with the relevant Volkswagen Retailer (and not with us).
7.4 The production vehicle includes different colours and trims. All such colours and trims are subject to availability. Payment of a pre‑booking fee and use of the pre‑booking process does not guarantee you access to any particular colour or trim, nor will you have priority over any other persons paying a pre‑booking fee and using the pre‑booking process.
7.5 If your preferred colour or trim is no longer available when you seek to place an order to purchase the production vehicle, then you [will be notified of this and] are free to amend your order or cancel your access to the Priority Ordering Window. If you cancel your access, the Volkswagen Retailer will refund your pre‑booking fee. The production vehicle is available subject to factory quota and availability. We are unable to guarantee that all orders for the 1st Edition launch model will be met. In this instance an alternative ID. Buzz model will be offered or you may request a refund of your pre- booking fee.
7.6 Please note that the Volkswagen Retailer cannot apply your pre‑booking fee to any order for the production vehicle, other than an order for a production vehicle placed during the Priority Ordering Window. If you prefer to wait for orders to formally open to the general public (and you therefore do not place an order for the production vehicle during the Priority Ordering Window), then you should contact your selected Volkswagen Retailer and request a refund of your pre‑booking fee.
7.7 The first customer deliveries of the production vehicle are currently expected to begin in January 2023 (subject to change at our sole discretion). Time of delivery may be decided by different factors, such as demand, factory production volumes, component supply, requested specification, engine, battery, trim and options, the corresponding time of production and your order's position in the queue. Therefore, the time of delivery may not correspond to the time you paid your pre‑booking fee or the time of your order – customers will be advised of likely lead times by the applicable Volkswagen Retailer on placing their order for the production vehicle. After placing an order for the production vehicle, customers will be updated on progress by their Volkswagen Retailer.
7.8 Customers who have paid a pre‑booking fee and secured access to the Priority Ordering Window will be kept informed with service messages, including important transactional information, as more information becomes available.
7.9 You must select your preferred Volkswagen Retailer at the time of completing the pre‑booking enquiry form and applying for access to the Priority Ordering Window. However, for order of the production vehicle and delivery, we reserve the right to assign you to a Volkswagen Retailer which may differ from your preferred Volkswagen Retailer. You may also place an order for the production vehicle at any other Volkswagen Retailer so long as you have your unique reference number and you have not already placed an order with a different Volkswagen Retailer.
8. Termination of the Priority Ordering Window/Pre‑booking fee Payment Scheme
8.1 We may close the Priority Ordering Window access/pre‑booking fee scheme to new applicants for any reason at any time. We will endeavour to provide notice on the Site before closing access to the scheme.
8.2 We may terminate the Priority Ordering Window access/pre‑booking fee scheme at any time, including without limitation if the vehicle does not go into production as scheduled for any reason. In such circumstances, Volkswagen Retailers will refund all pre‑booking fees paid by the payment method and to the card or other instrument which was used to pay the pre‑booking fee.
9. Changes to these Terms
9.1 We may change these Terms at any time by providing notice on the Site and by email to customers who have paid a pre‑booking fee. You are advised to check regularly for any such notices. If you do not agree with such changes, you may cancel your access to the Priority Ordering Window at any time and receive a refund of your pre‑booking fee from the Volkswagen Retailer in accordance with section 6 above.
10. Our Liability to You
10.1 We are under a legal duty to provide a pre‑booking process that conforms with the description on the Site and in these Terms. We will provide the pre‑booking process with reasonable skill and care.
10.2 We are responsible for foreseeable loss or damage caused by us. If we fail to comply with our obligations to you under these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into a contract on the basis of these Terms.
10.3 We are not liable for business losses. You agree not to use the pre‑booking process, access to the priority ordering window or any features on the site, for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
10.4 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. We therefore do not in any way exclude or limit our liability under or in connection with any contract with you based on these Terms for:
10.4.1 death or personal injury caused by our negligence;
10.4.2 fraud or fraudulent misrepresentation;
10.4.3 any matter for which it would be illegal for us to exclude or attempt to exclude our liability.
11. Privacy Notice
11.1 Please refer to our Privacy Notice for information about how we will use your personal information in connection with the pre‑booking process and how it will be shared.
12. Other important terms
12.1 Site availability and terms of use. We try to make the Site and the pre‑booking enquiry form available at all times, but, of course, due to the inherent nature of online and internet based services, we cannot guarantee this. Your use of the Site is governed by the terms of use set out here
12.2 Getting advice about your consumer rights. As a consumer, you have legal rights in relation to services that are not provided with reasonable skill and care or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.
12.3 We may transfer this agreement to someone else. We may transfer our rights and obligations under these Terms to another organisation within our group.
12.4 You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these Terms to another person if we agree to this in writing.
12.5 If a court finds part of these Terms illegal, the rest will continue in force. Each of the sections of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining sections will remain in full force and effect.
12.6 Which laws apply to these Terms and where you may bring legal proceedings. These Terms are governed by the law of England and Wales and we and you can bring legal proceedings in the English courts. Nothing in this section 12.6 shall deprive you of the right to bring or defend proceedings in your home state nor of the protection afforded to you by the mandatory rules of law of the country in which you live. For example, if you live in Scotland you can bring legal proceedings in either the Scottish or the English courts and if you live in Northern Ireland you can bring legal proceedings in either the Northern Irish or English courts.
12.7 Reliance on these Terms. We intend to rely on these written Terms and any document expressly referred to in them in relation to their subject matter. We and you will be legally bound by these Terms.
12.8 We are not responsible for delays outside our control. If we are prevented or delayed from complying with our obligations under these Terms by anything you (or anyone acting on your behalf) does or fails to do, or as a result of events or circumstances beyond our reasonable control, our inability or delay in performing our obligations will not be deemed to be in breach of contract.
12.9 References to 'including' and other similar expressions. In these Terms, words that appear after the expression 'include', 'including', 'other', 'for example', 'such as' or 'in particular' (or any similar expression) will not limit the meaning of the words appearing before such expression.
12.10 "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.
12.11 Waiver. If you breach these Terms and we choose to ignore your breach, or if we delay in taking steps against you, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms again.
